Acas response to the public consultation on the revision of the paragraphs 15 and 36 of the Acas Code of Practice of Discplinary and Grievance procedures

Acas launched a public consultation on the draft revisions made to the right of accompaniment sections in its disciplinary and grievance code following the EAT's judgment. The results of this consultation have been published alongside a revised draft of the Code. The draft Code is now subject to parliamentary approval. The consultation closed on 7 January 2014 and Acas sent the final version of the draft Code to the Department for Business, Innovation and Skills (BIS) on 7 February 2014. BIS laid the new Code in Parliament on 15 January 2015.

Acas Consultation on Draft Code of Practice on the extended right to request flexible working

Under the Government's proposals, announced in November last year, the right to request flexible working will be extended to all employees who have worked for their employer for 26 weeks or more. Employers are obliged to consider all requests in a reasonable manner.

The current statutory procedure will be repealed and the Government has asked Acas to produce a Code of Practice to help businesses manage this new extended right.

Through a public consultation, Acas sought views from employees and employers, particularly small businesses who often don't have HR support and may face challenges in managing flexible working requests.

The draft Code is designed to offer short, practical advice to make it as easy as possible for employers to handle requests and fit them to their specific circumstances and procedures.

Acas Consultation on Settlement Agreements Code of Practice

Acas has been asked by the Government to prepare a statutory Code of Practice to accompany the new legislation being introduced on settlement agreements. The aim of the Code is to help employers and employees negotiate settlement agreements by providing a clear explanation of the law as it relates to the confidentiality provisions of such negotiations.

Acas' Strategy Unit worked with the Acas Council to draft a Code and between 12 February and 9 April 2013 Acas consulted on the Draft Code of Practice on Settlement Agreements.
