The role of the Independent Expert

Where a claim is made for equal pay for work of equal value, the Employment Tribunal Service, after an initial filtering process, appoints an Independent Expert to investigate and report to the tribunal on whether the two jobs are of equal value.

Independent Experts are appointed by ACAS, from among academics, consultants and others deemed to have appropriate experience. They act on a fee-paid basis as required. The appointment of these cases is carried out by the Delivery Directorate at Acas National, London.

The designated experts are completely independent of both ACAS and the employment tribunals. We do, however, provide support to the experts by disseminating information about all aspects of equal pay legislation, key developments in case law, and any relevant employment relations implications. We also arrange for the experts to meet from time to time, to enable them to discuss and share their expertise drawing on their experiences and receive briefings from appropriate third parties.
